Court of Appeal Ruling On Increased Traffic and Council Tax Bands

The Court of Appeal today, 19th September 2008, confirmed the Valuation Office Agency’s view that increased traffic, on roads that had not otherwise altered since an initial council tax banding had been allocated to a property, does not represent one of the limited circumstances under which a formal challenge to a council tax banding can be made.

The High Court ruled on 19 December 2007 that increased traffic on roads could constitute a change in the “physical state” of a locality. The VOA subsequently appealed this decision to the Court of Appeal in a case that was heard on 9th July 2008.
